Upgrading the Class of Title

A registered title can be upgraded from a lower class of title to a higher class of title (for example Possessory Title upgraded to Absolute Title) on application to the HM Land Registry. This will increase the value of the property and can make the difference between a property that is not mortgageable, and which it would be difficult to sell and a property that is mortgageable and more easily sold.

Upgrading Possessory Title to Freehold Absolute Title:

Upgrading Freehold Possessory Title to Freehold Absolute Title can be achieved in the following circumstances:

1. Where further evidence is produced to the registrar at the HM Land Registry and they are satisfied as to the validity of the applicants claim to the title. This may occur where the applicant was originally granted Possessory Title on account of the fact that the title deeds were lost and the applicant was not able to prove their title and they have now found the title deeds and can now prove their right to the title.

2. The Title to the Property has been registered (without challenge) with Possessory Title for a period of 12 years.

Upgrading a Good Leasehold Title to Absolute Title:

Good Leasehold Title can be upgraded on application to HM Land Registry by the applicant providing full evidence of the validity of the Freehold Title and the Lessors right to grant the Lease.
